2. Description of Services

Protag offers a digital platform for creating and managing Digital Product Passports (DPPs) using AI and blockchain technology. Services include data automation, compliance monitoring, document generation, supplier/certifier integration, and more.

The platform is offered on a subscription basis under different pricing tiers, including an Enterprise license.

3. User Eligibility

You must be at least 18 years old and authorized to act on behalf of a business to use our Services. By registering, you confirm that all information provided is accurate and kept up to date.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access or suspected breach.

5. Use of Services

You agree to use the Services only for lawful purposes and in accordance with applicable laws and regulations (including EU regulations such as ESPR, CSRD, CBAM). You may not:

• Interfere with or disrupt the integrity or performance of the platform

• Attempt to reverse engineer, decompile, or disassemble any part of the service

• Use the platform to upload or distribute malicious software or unlawful content

6. Subscription, Payment, and Termination

Protag’s Services are provided under subscription models (monthly/annual). Subscription fees and service tiers are detailed in your commercial agreement.

• Billing and Payment: You agree to timely payment of all applicable fees.

• Cancellation: You may cancel at the end of your billing cycle.

• Termination: We reserve the right to suspend or terminate your access if you breach these Terms or applicable laws.

7. Intellectual Property

All content, code, design elements, and proprietary algorithms within the Protag platform are the intellectual property of Protag Systems AS. Clients retain ownership of their uploaded data and generated documentation, while granting Protag the right to process and store it as needed for service delivery.

You may not:

• Reproduce or redistribute platform components

• Use Protag’s branding without written permission

8. Data Handling and Privacy

All personal and organizational data is handled in accordance with our Privacy Policy, in full compliance with GDPR and Norwegian data protection regulations.

9. Third-Party Integrations

Protag may include integrations with external systems such as ERP software, certification bodies, and document repositories. We are not responsible for any service interruptions or liabilities caused by third-party platforms.

10. Limitation of Liability

To the fullest extent permitted by law, Protag shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, data loss, or business interruption, arising from the use or inability to use our Services.

Our total liability in any matter arising out of these Terms shall not exceed the fees paid by you for the Services over the previous 12 months.

11. Indemnification

You agree to indemnify and hold harmless Protag Systems AS, its directors, employees, and affiliates from any claims, losses, or damages arising from your misuse of the Services, violation of laws, or breach of these Terms.

12. Changes to Terms

We may update these Terms to reflect changes in our Services or legal obligations. We will notify users of material updates and post the revised Terms on this page. Continued use of the Services after such updates constitutes your acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway.
